Terms of Membership
1. Background
Active Brands AS (org.no: NO 995 767 813), with its registered address at Postboks 22 Vollebekk, 0516 Oslo (hereinafter referred to as "Active Brands"), operates a customer club program across its brands, including Kari Traa, Johaug, Dæhlie, Sweet Protection, and any other brands under Active Brands AS that may be added later ("The Brands"). By becoming a member of the Active Brands customer club, customers gain access to benefits when purchasing products through the official websites of the Brands.
These membership terms constitute an agreement for membership in the Active Brands customer club between the individual member (hereinafter referred to as the "member") and Active Brands. These membership terms are considered accepted when the customer joins the Active Brands customer club.
These membership terms apply to all members of the Active Brands customer club from October 15, 2023, and replace all previously applicable membership and user terms from this date.
2. Establishment of Membership in the Active Brands Customer Club
Membership in the Active Brands customer club is established by registering a profile on "My Account" on Active Brands' websites ("My Account") and accepting these membership terms. Refer to the separate Terms of Use for the user profile here.
Membership is personal, and only the registered member has the right to use the membership with its associated benefits. Membership in the Active Brands customer club is only available to individuals over 18 years old.
Membership is granted to only one person per membership number, and only physical persons can become members. A person cannot have more than one membership profile. Membership is registered with an email address provided by the member. Membership will be confirmed via email, and access will be granted by clicking on My Account.
There is no fee to register in the Active Brands customer club.
3. Member Communication, Consent, and Processing of Personal Data
Active Brands will store and process personal data necessary for Active Brands to comply with this agreement on the provision of the Active Brands customer club. The information provided will also be used for communication about membership in the Active Brands customer club. On My Account, it is also possible to consent to receive marketing communication, including information and offers via email, mobile, and digital ads. Consents can be withdrawn at any time.

4.Membership Benefits
Membership in the Active Brands customer club includes benefits from associated brands, such as early access to free shipping, sales, and exclusive discounts. For a complete and updated list of such benefits, visit one of the Brands' websites and log in to My Account.
5. Use of Account
Members are responsible for maintaining the confidentiality of their password and account and are fully responsible for all activities that occur under their password or account. Members should immediately inform Active Brands customer service (see contact information in the last section) of any unauthorized use of their password or account or other security breaches.
Members agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer, or upload for commercial purposes any part of the Active Brands customer club. The transfer, sale, or trade (or attempted transfer, sale, or trade) of exclusive member offers and any misrepresentation of facts related to this can result in the cancellation of the member's account.
6. Changes to Membership Terms
Active Brands reserves the right to make changes to these membership terms, including if: required by law, guidance, or directive from applicable authorities, changes are made to the Active Brands customer club that require such changes, changes are made to Active Brands' brands, or other substantive reasons.
Such changes may include expanding the Brands or changing the procedure for registering membership.
You will be informed in a timely manner about changes via My Account. Significant changes to the membership terms will be communicated via email or in another appropriate manner. If you do not accept the changes, you can terminate your membership at any time.
7. Termination of Membership
You can terminate your membership at any time by contacting us (see contact information in the last section).
Termination of membership, for any reason, means that you no longer have access to the Active Brands customer club. If you have terminated your membership, you can rejoin by registering on the Brands' official websites.
Active Brands reserves the right to terminate your membership with six months' notice. Any such notice will be sent via email, text message, or through other contact channels.
If your membership is terminated due to circumstances related to a country's legislation, a court decision, or a prohibition from a country's public authorities, Active Brands will not be held liable for any losses to the individual member resulting from this termination. Active Brands will, as far as possible, attempt to inform affected members as soon as possible if the circumstances described under this point come into effect.
8. Misuse of Membership
In accordance with applicable Norwegian law, Active Brands may hold you responsible for the misuse of membership that violates these membership terms or applicable law. This means that we may have the right to compensation for direct losses you have caused us through these actions.
In the event of misuse of the membership or benefits, Active Brands reserves the right to exclude the member in question from the program. Such misuse may include, but is not limited to, behavior that is harassing or shows a lack of respect for employees or partners, as well as criminal actions or actions generally considered immoral, unethical, or in violation of these membership terms.
Active Brands may cancel your membership if special reasons warrant it, including if we determine that you (a) are not eligible to be a member (for example, because you are under 18 years old), (b) have not used your account for over 2 years, (c) have violated terms or conditions or applicable law or regulation, or (d) have committed other misuse of your membership.
9. Force Majeure – Events Beyond Our Control
Active Brands is not responsible for loss or damage resulting from events beyond our control, including changes in legislation, government actions, acts of war, strikes, blockades, boycotts, lockouts, pandemics, or other similar events.
10. Liability
You are entitled to compensation for direct economic loss if the loss is due to circumstances within Active Brands' control.
Membership in the Active Brands customer club is provided "as is" and "as available." To the fullest extent permitted by applicable law, Active Brands disclaims all warranties of any kind, express, implied, or statutory, regarding the Active Brands customer club (including those related to fitness for a particular purpose and non-infringement).
Keep a copy of these membership terms for archival purposes, and check the website regularly for any changes to the terms.
11. Transfer of this Agreement
Active Brands has the right to transfer this membership agreement to another company that will continue to operate the Active Brands customer club.
12. Choice of Law
These membership terms are subject to Norwegian law.
